Хуулийн өршөөлд 2017 оны зургаадугаар сарын 30-ны өдрийн 00:00 цагаас өмнө 2002 онд баталсан Эрүүгийн хууль болон 2021 оны зургаадугаар сарын 24-ний өдрийн 00:00 цагаас өмнө 2015 онд баталсан Эрүүгийн хуульд заасан зарим гэмт хэрэг болон зарим зөрчил үйлдсэн хүн, хуулийн этгээдэд хамаарна.
Өршөөлийн тухай хуульд 38 төрлийн гэмт хэрэг хамрагдахгүй. Өмнө нь Өршөөлийн тухай хуулиар хорих ялаас чөлөөлөгдөж, ахин хорих ялаар шийтгэгдсэн хүнийг энэ удаагийн хуульд хамруулаагүй ажээ.
